D\u00c9CRET:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\nWhereas the Governor in Council is of the opinion that\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n(a)\u2002based on the declaration of a pandemic by the World Health \nOrganisation, there is an outbreak of a communicable disease, namely \nCOVID-19 coronavirus disease, in the majority of foreign countries;\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n(b)\u2002the introduction or spread of the disease would pose an&nbsp;imminent and severe risk to public health in Canada;\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n(c)\u2002the entry of persons into Canada who have recently been in a&nbsp;foreign\n country may introduce or contribute to the spread of the&nbsp;disease in \nCanada; and\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n(d)\u2002no reasonable alternatives to prevent the introduction or spread of the disease are available;  \n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\nTherefore, Her Excellency the Governor General in Council, on the \nrecommendation of the Minister of Health, pursuant to section 58 of the <em>Quarantine Act<\/em>, makes the annexed <em>Minimizing the Risk of Exposure to COVID-19 Coronavirus Disease in Canada Order (Prohibition of Entry into Canada)<\/em>.  \n<br><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\nAttendu que la gouverneure en conseil est d\u2019avis\u2009:\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\na)\u2002que, compte tenu de la d\u00e9claration de pand\u00e9mie de l\u2019Organisation \nmondiale de la sant\u00e9, la majorit\u00e9 des pays \u00e9trangers est aux prises avec\n l\u2019apparition d\u2019une maladie transmissible, soit la&nbsp;maladie \u00e0 coronavirus\n COVID-19;\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\nb)\u2002que l\u2019introduction ou la propagation de cette maladie pr\u00e9senterait un\n danger grave et imminent pour la sant\u00e9 publique au&nbsp;Canada;\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\nc)\u2002que l\u2019entr\u00e9e au Canada de personnes qui ont r\u00e9cemment s\u00e9journ\u00e9 dans \nces pays favoriserait l\u2019introduction ou la propagation de la maladie au \nCanada;\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\nd)\u2002qu\u2019il n\u2019existe aucune autre solution raisonnable permettant de \npr\u00e9venir l\u2019introduction ou la propagation de la maladie au Canada;\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n\u00c0 ces causes, sur recommandation de la ministre de la&nbsp;Sant\u00e9 et en vertu de l\u2019article 58 de la <em>Loi sur la mise en quarantaine<\/em>, Son Excellence la Gouverneure g\u00e9n\u00e9rale en conseil prend le <em>D\u00e9cret\n visant la r\u00e9duction du risque d\u2019exposition \u00e0 la maladie \u00e0 coronavirus \nCOVID-19 au Canada (interdiction d\u2019entr\u00e9e au Canada)<\/em>, ci-apr\u00e8s.\n<br><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>Minimizing the Risk of Exposure to COVID-19 Coronavirus Disease in Canada Order (Prohibition of Entry into Canada)  <\/strong>\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>Definition of <em>immediate family member<\/em>&nbsp;&nbsp;<\/strong>\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>1<\/strong>\u2002In this Order, <em>immediate family member<\/em>, in respect of a person means\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>(a)<\/strong>\u2002 the spouse or common-law partner of the person;\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>(b)<\/strong>\u2002 a dependent child of the person or of the person\u2019s spouse or common-law partner; or\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>(c)<\/strong>\u2002a dependent child of a dependent child referred to in paragraph (b)\u200d.  \n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>Prohibition  <\/strong>\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>2<\/strong>\u2002Any <em>foreign national<\/em>, as defined in subsection 2(1) of the <em>Immigration and Refugee Protection Act<\/em>, is prohibited from entering Canada if they arrive by means of an aircraft from a foreign country.  \n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>Non-application  <\/strong>\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>3<\/strong>\u2002Section 2 does not apply to\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>(a)<\/strong>\u2002a person who has been only in the United States or \nCanada during the period of 14 days before the day on which they arrived\n in Canada;\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>(b)<\/strong>\u2002an immediate family member of a Canadian citizen or of a <em>permanent resident<\/em> as defined in subsection 2(1) of the <em>Immigration and Refugee Protection Act<\/em>;\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>(c)<\/strong>\u2002a person registered as an Indian under the <em>Indian Act<\/em>;\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>(d)<\/strong>\u2002a person who is authorized, in writing, by a \nconsular officer of the Government of Canada to enter Canada for the \npurpose of reuniting immediate family members;\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>(e)<\/strong>\u2002a <em>crew member<\/em> as defined in subsection 101.01(1) of the <em>Canadian Aviation Regulations<\/em>;\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>(f)<\/strong>\u2002a person who is exempt from the requirement to obtain a temporary resident visa under paragraph 190(2)(a) of the <em>Immigration and Refugee Protection Regulations<\/em> and the immediate family members of that person;<br><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>(g)<\/strong>\u2002a person who enters Canada at the invitation of the\n Minister of Health for the purpose of assisting in the COVID-19 \ncoronavirus disease response;\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>(h)<\/strong>\u2002a person who arrives by means of an aircraft operated by the Canadian Forces or the Department of National Defence;\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>(i)<\/strong>\u2002a member of the Canadian Forces or a <em>visiting force<\/em> as defined in section 2 of the <em>Visiting Forces Act<\/em> and the immediate family members of that member;\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>(j)<\/strong>\u2002a protected person within the meaning of subsection 95(2) of the <em>Immigration and Refugee Protection Act<\/em>;\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>(k)<\/strong>\u2002a French citizen who resides in \nSaint-Pierre-et-Miquelon and has been only in Saint-Pierre-et-Miquelon, \nthe United States or Canada during the period of 14 days before the day \non which they arrived in Canada;\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>(l)<\/strong>\u2002a person or any person in a class of persons who, \nin the opinion of Chief Public Health Officer appointed under subsection\n 6\u200d(1) of the <em>Public Health Agency of Canada&nbsp;Act<\/em>\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>(i)<\/strong>\u2002does not pose a risk of significant harm to public health, or\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>(ii)<\/strong>\u2002will provide an essential service while in Canada;\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>(m)<\/strong>\u2002a person whose presence in Canada, in the opinion \nof the Minister of Foreign Affairs, the Minister of Citizenship and \nImmigration or the Minister of Public Safety and Emergency Preparedness,\n is in the national interest; or\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>(n)<\/strong>\u2002a person who arrives by means of an aircraft, if \nthe scheduled arrival in Canada according to the flight plan is before \n11:59 p.m. Eastern Daylight Time on March 18, 2020.  \n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>Powers and obligations  <\/strong>\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>4<\/strong>\u2002For greater certainty, this Order does not affect any of the powers and obligations set out in the <em>Quarantine Act<\/em>.  \n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>Effective period  <\/strong>\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>5<\/strong>\u2002This Order has effect for the period beginning at \nnoon Eastern Daylight Time on March 18, 2020 and ending at noon Eastern \nDaylight Time on June 30, 2020.  \n<br><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>D\u00e9cret visant la r\u00e9duction du risque d\u2019exposition \u00e0 la maladie \u00e0\n coronavirus COVID-19 au Canada (interdiction d\u2019entr\u00e9e au Canada)<\/strong>\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>D\u00e9finition de <em>membre de la famille imm\u00e9diate<\/em><\/strong>\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>1<\/strong>\u2002Dans le pr\u00e9sent d\u00e9cret, <em>membre de la famille imm\u00e9diate<\/em> s\u2019entend, \u00e0 l\u2019\u00e9gard d\u2019une personne\u2009:\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>a)<\/strong>\u2002de son \u00e9poux ou conjoint de fait;\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>b)<\/strong>\u2002de tout enfant qui est \u00e0 sa charge ou \u00e0 la charge de son \u00e9poux ou conjoint de fait;\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>c)<\/strong>\u2002de l\u2019enfant \u00e0 charge d\u2019un enfant \u00e0 charge vis\u00e9 \u00e0 l\u2019alin\u00e9a b).\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>Interdiction<\/strong>\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>2<\/strong>\u2002Il est interdit \u00e0 tout <em>\u00e9tranger<\/em> au sens du paragraphe 2(1) de la <em>Loi sur l\u2019immigration et la protection des r\u00e9fugi\u00e9s<\/em> d\u2019entrer au Canada s\u2019il arrive \u00e0 bord d\u2019un a\u00e9ronef en provenance d\u2019un pays \u00e9tranger.\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>Non-application<\/strong>\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>3<\/strong>\u2002L\u2019article 2 ne s\u2019applique pas aux personnes suivantes\u2009:\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>a)<\/strong>\u2002la personne qui a s\u00e9journ\u00e9 uniquement aux \u00c9tats-Unis\n ou au Canada durant la&nbsp;p\u00e9riode de quatorze jours pr\u00e9c\u00e9dant le jour de \nson arriv\u00e9e au Canada;\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>b)<\/strong>\u2002le membre de la famille imm\u00e9diate d\u2019un citoyen canadien ou d\u2019un <em>r\u00e9sident permanent<\/em> au sens du paragraphe 2(1) de la <em>Loi sur l\u2019immigration et la protection des r\u00e9fugi\u00e9s<\/em>;\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>c)<\/strong>\u2002la personne qui est inscrite au registre des Indiens en vertu de la <em>Loi sur les Indiens<\/em>;\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>d)<\/strong>\u2002la personne qui est autoris\u00e9e, par \u00e9crit, par un \nagent consulaire du gouvernement du Canada d\u2019entrer au Canada dans le \nbut de r\u00e9unir les membres d\u2019une famille imm\u00e9diate;\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>e)<\/strong>\u2002le <em>membre d\u2019\u00e9quipage<\/em> au sens du paragraphe 101.01(1) du <em>R\u00e8glement de l\u2019aviation canadien<\/em>;\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>f)<\/strong>\u2002la personne qui est dispens\u00e9e de l\u2019obligation d\u2019obtenir un visa de r\u00e9sident temporaire en application de l\u2019alin\u00e9a 190(2)a) du <em>R\u00e8glement sur l\u2019immigration et la protection des r\u00e9fugi\u00e9s<\/em> ainsi que les membres de sa famille imm\u00e9diate;<br><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>g)<\/strong>\u2002la personne qui entre au Canada \u00e0 l\u2019invitation de la\n ministre de la Sant\u00e9 afin de participer aux efforts de lutte contre la \nmaladie \u00e0 coronavirus COVID-19;\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>h)<\/strong>\u2002la personne qui arrive \u00e0 bord d\u2019un a\u00e9ronef exploit\u00e9 par les Forces canadiennes ou le&nbsp;minist\u00e8re de la D\u00e9fense nationale;\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>i)<\/strong>\u2002le membre des Forces canadiennes ou d\u2019une <em>force \u00e9trang\u00e8re pr\u00e9sente au Canada<\/em> au sens de l\u2019article 2 de la <em>Loi sur les forces \u00e9trang\u00e8res pr\u00e9sentes au Canada<\/em> ainsi que les&nbsp;membres de sa famille imm\u00e9diate;\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>j)<\/strong>\u2002la personne prot\u00e9g\u00e9e au sens du paragraphe 95(2) de la <em>Loi sur l\u2019immigration et la&nbsp;protection des r\u00e9fugi\u00e9s<\/em>;\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>k)<\/strong>\u2002le citoyen fran\u00e7ais qui r\u00e9side \u00e0 \nSaint-Pierre-et-Miquelon et qui a s\u00e9journ\u00e9 uniquement \u00e0 \nSaint-Pierre-et-Miquelon, aux \u00c9tats-Unis ou au Canada durant la p\u00e9riode \nde quatorze jours pr\u00e9c\u00e9dant le jour de son arriv\u00e9e au Canada;\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>l)<\/strong>\u2002la personne qui, individuellement ou au titre de son\n appartenance \u00e0 une cat\u00e9gorie d\u00e9termin\u00e9e de personnes, selon \nl\u2019administrateur en chef nomm\u00e9 en application du&nbsp;paragraphe 6(1) de la <em>Loi sur l\u2019Agence de la sant\u00e9 publique du Canada<\/em>\u2009:\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>(i)<\/strong>\u2002soit ne pr\u00e9sente pas de danger grave pour la sant\u00e9 publique,\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>(ii)<\/strong>\u2002soit fournira un service essentiel durant son s\u00e9jour au Canada;\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>m)<\/strong>\u2002la personne dont la pr\u00e9sence au Canada est, de \nl\u2019avis du ministre des Affaires \u00e9trang\u00e8res, du ministre de la \nCitoyennet\u00e9 et de l\u2019Immigration ou du ministre de la&nbsp;S\u00e9curit\u00e9 publique \net de la Protection civile, dans l\u2019int\u00e9r\u00eat national;\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>n)<\/strong>\u2002la personne qui arrive \u00e0 bord d\u2019un a\u00e9ronef dont le \nplan de vol pr\u00e9voit une arriv\u00e9e au&nbsp;Canada avant 23&nbsp;h&nbsp;59, le 18 mars \n2020, heure avanc\u00e9e de l\u2019Est.\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>Pouvoirs et obligations<\/strong>\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>4<\/strong>\u2002Il est entendu que le pr\u00e9sent d\u00e9cret ne porte pas atteinte aux pouvoirs et aux obligations pr\u00e9vus par la <em>Loi sur la mise en quarantaine<\/em>.\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\n<strong>Dur\u00e9e<\/strong>\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"> <strong>5<\/strong>\u2002Le pr\u00e9sent d\u00e9cret
